Mobile Car BodyWorks Ltd. Terms and Conditions of Business.

Definitions:
“Mobile Car BodyWorks Ltd.”, “We”, “Us” refers to the Mobile Car BodyWorks Ltd. trading company as shown on the face of the invoice/estimate.
Estimates, Bookings and Repair Location

Any Estimate provided by Mobile Car BodyWorks Ltd. prior to inspection of the damage is indicative only and subject to revision. Once the vehicle has been inspected you will be provided with a written Estimate (or a revised Estimate as the case may be) by email, or by post if email is not available, which will be an offer to carry out repairs to the damage indicated at the price stated. The Customer’s agreement to proceed with the repairs constitutes acceptance of that offer and forms a binding legal contract incorporating these Terms of Business.

If for any reason, including but not limited to inclement weather, Mobile Car BodyWorks Ltd. is unable to carry out the repair or collection at the time date or location indicated on the Estimate. Any and all liability incurred by Mobile Car BodyWorks Ltd. as a result shall be discharged by Mobile Car BodyWorks Ltd. Making an offer to conduct the repair at the Estimate price at an alternative time date or location convenient to both parties, whether or not such time date and location is identified or such offer is accepted.

Repairs may be completed at a location agreed with the customer, or at Mobile Car BodyWorks Ltd.’s nominated location. Mobile Car BodyWorks Ltd. has absolute discretion to decide on the location for the repair. This decision may be changed, including on the date of the booked repair. As variable factors including but not limited to weather and available light affect the decision. If Mobile Car BodyWorks Ltd decides that the repair should be completed at a location other than that originally envisaged, the customer authorises us to remove the vehicle to such an appropriate location. Removal and return of the vehicle in these circumstances will be a service provided by Mobile Car BodyWorks Ltd. at no further charge.

The customer or owner’s vehicle must be insured with a current MOT and road TAX.

Cancellation Rights

You have the right to cancel this contract and you may exercise this right by delivering or sending by email/text to the person named on the Estimate at any time within fourteen (14) days of the Booking Date. This notice of cancellation will be deemed to have been served as soon as it is posted or, in the case of an email/text, from the day it has been sent.

Carrying Out the Repairs

Mobile Car BodyWorks Ltd. undertakes to carry out the repairs indicated on the Estimate. If it becomes clear during the work that, in the opinion of the repairer, further work is necessary to properly complete the repairs outlined on the estimate. The customer’s authorisation and agreement will be obtained before any further work is undertaken that would increase the price shown on the estimate. If such authorisation is not forthcoming, we reserve the right not to continue with the repairs that require the further work. In these circumstances the full estimate price remains payable by the customer. Further work that does not increase the Estimate price maybe proceeded with without the requirement for customer authorisation.

No repair will be identical to an automotive factory finish, which is machine-sprayed to tolerances beyond human capability. Hence no repair will ever be ‘as good as new’. Mobile Car BodyWorks Ltd. discharges its obligations under any repair agreement by providing a good quality, hand-completed aftermarket repair. In normal circumstances, such a repair is unlikely to be detected by a casual examination of the vehicle by an untrained observer unaware of the previous damage location.

Where parts are required to complete a repair, they must be purchased in advance of the repair date by the customer. In the case of Mobile Car BodyWorks Ltd. purchasing the part they must be paid for in advance prior to repair.

The Mobile Car BodyWorks Ltd. repair system includes elements (including but not limited to factory paint reproduction recipe database) that are provided by third parties. Finish (including but not limited to colour) match may be approximate only when limitations of such third party supplied elements prevent a more precise finish match. In any such case, provision by Mobile Car BodyWorks Ltd. of an approximate finish match will be considered supply of a good quality repair.

It is the absolute responsibility of the customer to advise Mobile Car BodyWorks Ltd. of any non-original finish areas on the vehicle. In case of incompatibility with a non-original finish (whether or not notified by the customer) we have the right to void this contract – in these circumstances, Mobile Car BodyWorks Ltd. will not be obliged to complete or rectify any repair and the customer will not be obliged to make payment. Liability for mutual contractual mistake under this agreement rests with the customer.

Mobile Car BodyWorks Ltd. will not be liable for any third-party inspection. End of lease inspectors may, as trained experts in their field be able to identify Repairs.

Reverse Parking Sensor/Dash Cam/GPS Tracker/Reversing Camera Fitting

Mobile Car BodyWorks Ltd. will check the vehicle before and after installation. We may ask you to sign a job completed invoice/satisfaction sheet upon completion. Mobile Car BodyWorks Ltd. advises the customer checks the vehicle with us before and after the installation, any faults or problems with the vehicle must be raised and discussed with us before we leave the site. Any claims thereafter are not liable, we will not be held responsible once we have left the site.

As these fittings are classed as vehicle modification’s you may need to inform/check with your insurance company.

In cases where Mobile Car BodyWorks Ltd. does not supply but fit parts, we will only guarantee the fitting not the supplied parts.

Advance Driver Assistance Systems – ADAS Re-Calibration

If your vehicle is fitted with ADAS, vehicle manufacturers specify that ADAS systems may require recalibration following repair work to ensure that the ADAS system continues to operate. We will advise you at the point of your initial estimate if our system provides an advisory that your vehicle has or may have ADAS fitted. For the avoidance of doubt, we do not complete ADAS re-calibration services within the repair. You will need to arrange re-calibration with your dealership network, or we can recommend a third-party company to perform this recalibration. If re-calibration is required, it is your sole responsibility to ensure this work is carried out in a timely manner at your cost.

Extent of Guarantee

Mobile Car BodyWorks Ltd. guarantee repairs for a period of two years. This is a formulation and application guarantee: that the finish will not degrade due to the paint being improperly mixed or applied by us. No guarantee of any sort is offered against damage to the finish by any corrosion or rust (whether or not evident before the repair was carried out). By failure of the surface to which the repair is applied (including but not limited to failure of a previous aftermarket paintwork repair), further accident or impact (including but not limited to stone chipping) or by inappropriate aftercare once the vehicle has been returned to the customer. Aftercare instructions will be supplied by Mobile Car BodyWorks Ltd. with the customer invoice.

Chip repairs, ‘touch-ins’ and any other repairs identified as such to the customer by Mobile Car BodyWorks Ltd. will be on an ‘improve only’ basis, and no representation is made and no guarantee offered that such a repair will be in any way undetectable against the original finish. Repairs may be identified as an attempt to “improve only’ in which case Mobile Car BodyWorks Ltd. do not guarantee any improvement. Claims under the Mobile Car BodyWorks Ltd. guarantee are settled by free rectification or (at Mobile Car BodyWorks Ltd.’s discretion) a refund equal to the portion of the invoice price representing the unsatisfactory repair. Any refund or liability shall be limited to a maximum of the amount quoted upon the estimate or invoice. Mobile Car BodyWorks Ltd. will not be liable for any consequential loss incurred as the result of a repair. It is incumbent on the customer to keep a receipt as proof of work carried out. Any Guarantee claim made without a receipt shall be at Mobile Car BodyWorks Ltd.’s discretion.

In cases where Mobile Car BodyWorks Ltd. does not supply but fit parts etc., we will only guarantee the fitting not the parts.

The Guarantee is not transferable.

Payment

Unless other arrangements have been agreed beforehand, payment in full is due on completion of the repair and shall be by cheque, cash, bank transfer and credit or debit card (subject to the card processing fee in force at the time of payment). We regret we are unable to process payment by American Express. Mobile Car BodyWorks Ltd. is entitled to exercise a lien over the repaired vehicle until satisfactory payment is made by the customer, which in the case of payment by cheque shall be deemed to have taken place when a cheque has cleared the banking process. Third party cheques are not accepted. All materials/goods remain property of Mobile Car BodyWorks Ltd. until fully paid for.

Mobile Car BodyWorks Ltd. do not sell your details to any third party for marketing purposes.
